Getting Divorced or Separated

As you think about this transition, here are some important things for you to consider:
There are some important changes that will need to take place on your auto policy if you are going through a separation or divorce. We want to make this difficult time go as smoothly as possible for you. We will be there every step of the way to make these transitions quick and as painless as possible. We do also want to be sure you are both still protected properly.
Once your spouse moves out, you should update the garaging addresses and commuting distance of all vehicles. This is the first step before splitting the joint auto policy. You can not just remove the spouse as a driver or his or her vehicle or remove his or her name from the policy. There are specific steps that must be taken in order to legally remove a vehicle and driver from an auto policy in New York.
If a vehicle is titled and registered to both of you, then you will need to wait until the divorce is final to separate out insurance. Before changing over any titles or registrations, you should review with your attorney to see if that is possible.
Once the divorce is final, then you should get separate car insurance policies. Give us a call. We can spin one or both of you off onto your own policy or policies. If the title and/or registration is in both names then you will want to get that switched to the appropriate party. You will need an updated ID card prior to heading to the Department of Motor Vehicles. We can provide this for you and advise you of the steps that need to be taken to handle your unique situation properly.

Usually, if a child lives more frequently with one parent, then the child should be covered by the insurance policy of that parent. These issues are not always clear-cut so it is best to review the circumstances with us to make sure that the coverage is structured properly based on that your specific company's rules.

Homeowner's or Renter's Insurance
If you are separating you may not be able to remove your spouses name from the insurance policy until the divorce is final.
